Understanding Malicious Destruction of Property (MDOP) in Michigan

Understanding Malicious Destruction of Property (MDOP) in Michigan

Malicious Destruction of Property (MDOP) is a serious crime in Michigan, involving the intentional and willful destruction or injury of someone else’s personal property. Often mistaken for simple vandalism, MDOP encompasses a wide range of destructive acts that go beyond graffiti and mailbox damage. Understanding the severity of these charges and the potential penalties is crucial for anyone accused of this offense.

What Constitutes Malicious Destruction of Property?

MDOP occurs when an individual deliberately damages or destroys another person’s property. The law recognizes various degrees of this crime, each with its own set of penalties:

  • 4th Degree (Misdemeanor): This applies to first-time offenders who cause less than $200 in damages. Penalties include up to 93 days in jail and/or fines of up to $500 or three times the property damage, whichever is greater.
  • 3rd Degree (Misdemeanor): This degree applies to individuals with prior offenses who cause between $200 and $1,000 in damages. The penalties include up to 1 year in jail and/or fines of up to $2,000 or three times the property damage.
  • 2nd Degree (Felony): For those with one or more prior offenses and who cause between $1,000 and $20,000 in damages, this felony charge can result in up to 5 years in prison and/or fines up to $10,000 or three times the property damage.
  • 1st Degree (Felony): This most severe charge is for those with two or more prior offenses who cause more than $20,000 in damages. Penalties include up to 10 years in prison and/or fines up to $15,000 or three times the property damage.

Special Circumstances and Aggregated Charges

Certain acts of property destruction automatically result in felony charges, regardless of the damage amount. These include damage to emergency vehicles, school buses, bridges, dams, and utility lines. Additionally, if property damage is committed over a period of time, the total damage can be aggregated to determine the severity of the charge.
